In dem Buch: Die Soldaten der Wehrmacht, Verlag Herbig, mit einem Geleitwort von Bundesminister a. D. Gerhard Stoltenberg bin ich unter dem Kapitel Kriegsverbrechen auf folgenden Absatz gestossen:
Es ist aufschlussreich zu vergleichen, wie sich die amerikanische Militaerjustiz in Faellen nachweislicher Kriegsverbrechen verhielt. Die Akten des US Judge Advocate General, Department of the Army, Washington, D.C. geben dazu Auskunft. Ein Beispiel: Das Urteil eines Court Martial gegen den amerikanischen Leutnant Vicent C. Acunto betrifft die Erschiessung von etwa 24 deutschen Kriegsgefangenen und drei deutschen Zivilisten am 8. April 1945 in Tambach, in der Naehe Coburgs. Die Anklage gegen ihn lautete auf Mord. Das Gericht hat ihn am 1. Juni 1945 freigesprochen, weil er behauptete, von der Haager Landkriegsordnung und von den Genfer Konventionen nichts gewusst zu haben. Eine amerikanische Untersuchung des Falles stellte spaeter fest: "The record of trial in the Acunto case makes it evident, that the accused was, in fact guilty of the murder of serveral prisoners of war, and that the general court-martial before wich he was tried erred gravely in acquitting him. In making their duty and their oaths, or else they accepted the wholly untenabel theory that the instructions of a supperior officer will justify the doing of a patently criminal act. The accused freely admitted causing the prisioners of war to be taken out and shot to death. The defense rested upon his ignorance of the rules of land warfare and upon alleged condonation and encouragement by division and army commanders of the shooting of prisoners of war.
Of the other members of the command found by Board of Officers to be implicated in the matter, PFC Pacchiano was acquittet, and the charges against all others were dropped. It does not appear that the divisional comander reprimandet the court for its manifest error. Zitat Ende.
